Legal Metrology, Weight, and Measurement play an important role in our day-to-day lives. Increasing the importance of weight and measures in the Indian Market is also increasing the fraud in weight and measures.
These frauds are conducted by the Dealer, manufacturer, seller, importer or packer of the commodity who deals in weight and measures and conduct the fraud by using the false or incorrect weight or measure which the intention to cheat the customer and conduct the fraud. Fraud by dealer of Weight and Measure Let's start with the word "fraud." What does it mean and how does it take place in weight and measures? Fraud can be defined as misconduct done by any person who intends to deceive someone to achieve personal gain or cause damage or loss to another individual. Intentional and willful representation of all facts is the component of fraud when a person intentionally conducts something wrong or commits something wrong against another person. However, there are various kinds of fraud that occur, and some of them take place in weight and measures as well. By keeping yourself aware, you can protect yourself from such frauds; and if any consumer thinks that any trader, manufacturer, or importer is conducting any kind of fraud, then he should file a complaint about that, and the person will be charged under sections 264 to 276 of IPC, 1860. These sections were enacted to protect the consumer from such frauds of weight and measure and to stop the malpractice of weight and measure in the Indian market. Any person committing the offense under in weight or measure shall be liable for the punishment discussed above. Punishment under IPC for wrong weight or measure usage As per Indian Penal Code, it states “that whoever makes a sale or disposes of any instrument for weight or any measure of length or capacity which he knows to be false so that the same may be used as true or knowing that the same is likely to be used as true shall be punished with imprisonment under either description for a term which may extend up to one year or fine or both” The Indian Legal Metrology System is increasing its scope regularly, and the Legal Metrology offices are set up in different parts and states of the country, where the person or applicant can approach them easily. Who can conduct the Legal Metrology Fraud? Fraud under Legal Metrology can be conducted by the Dealer, Manufacturer, Importer, Packer, or Seller of the Commodity. Any person who deals in Weight and Measures can conduct the fraud and the same shall be liable for the punishment under the Act of the Indian Penal Code. How the Fraud can be conducted under weight and measures? For a trader, it become sometimes very easy to conduct the Fraud as he regularly deals in weight and measures. These frauds take place when the wrong weight and measures are used by the trader deliberately and intentionally to earn the wrongful gain and with an intent to cheat the customer. Any kind of use of false or wrong weight or measure leads to fraud and offense conducted by the trader towards the customer, citizen of the country, and the market as well.
